Terms and Conditions


THESE TERMS AND CONDITIONS OF USE (“Terms and Conditions”) govern your use of this Patient Portal, the patient portal web, email and internet access to Overlake Internal Medicine Associates, P.S. and its providers.

For purposes of these Terms and Conditions, “We” “us” and “our” refer to Overlake Internal Medicine Associates, P.S. and its providers who offer the Patient Portal service to you.  “Your provider(s)” refers to the specific provider(s) with whom you maintain a treatment relationship. 



Patient Portal is not intended to deter you from other methods of communication with us or your provider.  It is an additional option and not a replacement.

This Patient Portal site is designed to provide general health and medical information and resources and should not be used as a substitute for your provider’s advice. If you have a medical problem or condition, seek the personal consultation of your provider.   Electronic communications and emails from you to any or your providers must be sent through the Patient Portal for the assurance of security and confidentiality. The Patient Portal messages will be handled by our staff in a manner similar to how phone communication is handled.  Although we strive to reply to messages within one business day, we cannot guarantee that we will be able to address your message in that timeframe. We encourage you to use the Patient Portal at any time, but please understand that we will only reply to messages during our office hours, excluding holidays recognized by us. If you do not receive a response within two business days, please feel free to call our office. It is your responsibility to provide us with your correct email address and inform us immediately of any change.

The thoroughness of responses to your online communications may be limited by the information you provide. Your question(s) may necessitate a follow-up call or a request to meet with you in person to gain further information.  Electronic communications will be viewed by not only your provider, but the staff members assigned to handle such communications and any other providers covering for your provider if your provider is unavailable to respond.  Accordingly, you should not communicate via Patient Portal if you desire to communicate sensitive information only directly with an individual provider.


We do not guarantee that we will respond to all inquiries and we reserve the right to ignore or delete any information including, without limitation, information that is fraudulent, abusive, defamatory, obscene, or in violation of a copyright, trademark or other intellectual property or ownership right of any other person.  When we receive an email, we make reasonable efforts to respond in as timely a manner as possible but we cannot represent or warrant how quickly we will be able to respond and you should not refrain from seeking medical treatment while waiting for information from us.

We will keep a copy of all online communications which are deemed by us to be medically important, in your medical record, as per applicable federal and state laws and regulations.  You should print or store in a secure place (on a computer or storage device owned and controlled by you) a copy of all Patient Portal communications that are important to you.  We will not forward online communications with you to third parties except as authorized by you or required by law.

Your Medical Record

As we provide your health care, we are required to maintain documentation of your medical history, current conditions, treatment plan, and all treatments given, including but not limited to the results of all tests, procedures and therapies. All electronic medical record information is subject to all state and federal statutes governing the security and confidentiality of medical records.

Please keep in mind that the medical information presented through Patient Portal does not include all of the medical information available in your permanent medical record. The posting of your medical information is limited by the Patient Portal service and further at the discretion of your provider(s).

If you use the Patient Portal service, you may receive messages, test results and other communications delivered via Patient Portal. Accordingly, your provider(s) will not send duplicate written reports of this information, unless you specifically request a written report.

Before signing up for the Patient Portal service, you should understand that the medical information included in Patient Portal may include medical information you consider very personal including information about sexually transmitted and other communicable diseases, drug and alcohol abuse, HIV/AIDS, and mental health services.

Your Responsibilities

By using Patient Portal, you agree to be bound by these Terms and Conditions. You understand that these Terms and Conditions may be modified from time to time as communicated to you.  You agree that it is your responsibility to periodically review the Terms and Conditions and that your use (and continued use) of Patient Portal shall represent your agreement to be bound by the Terms and Conditions existing at the time of your use of the Patient Portal service.

You agree that you are solely responsible for your use of Patient Portal.  You agree that you will not utilize the Patient Portal service to communicate offensive, hateful, defamatory, harassing, or discriminatory speech. You should not share your Patient Portal access with others.  Special care should be taken with any information that you print out of Patient Portal.

Take steps to keep your online communications to and from us confidential.  It is recommended that you do not store messages on any employer-provided devices (e.g. computer, cell phone, tablet, etc.) as personal information could be accessible or owned by your employer. Use a screen saver or close your messages instead of leaving messages on the screen for passersby to read. Keep your passwords safe and private. Do not allow individuals or third parties access to the device(s) upon which you store medical communications. Keep your login and password information secure and confidential.  Consider alternatives to use of your standard email for medical communications with us.  Standard email lacks the necessary security and privacy features and may expose your medical communications to us or from us to you to employers or other unintended third parties.

Discontinuing Use of Patient Portal

You acknowledge that Patient Portal is a service offering afforded to you to promote effective communication between you and your providers.  You agree that your providers are not obligated to offer the Patient Portal service to you and that your provider(s) may terminate your ability to access and/or use Patient Portal for any reason, including violation of these Terms and Conditions. 

You can discontinue your use of Patient Portal at any time by contacting your provider.

Site Access and Licenses

You are granted a limited, revocable license to make personal use only of the Patient Portal site and the associated services in accordance with these Terms and Conditions. This license EXPRESSLY EXCLUDES, without limitation, any reproduction, duplication, sale, resale or other commercial use of the website and the associated services, making any derivative of the website or the associated services, the collection and use of user email addresses or other user information, including, without limitation, health information or any data extraction or data mining whatsoever.  Through this license, you may be able to upload third party data into Patient Portal or download limited medical information from Patient Portal to select third party sites.

We reserve the right in the future to charge a fee for the use of Patient Portal.  You will be notified of this change and asked to re-apply if you agree to the fee and wish to continue with this service.


This website uses information security safeguards and protections.  However, no system can perfectly guard against risks of intentional intrusion or inadvertent disclosure of information.  Information will be transmitted over a medium that is beyond our control.  YOU HEREBY EXPRESSLY ASSUME THE SOLE RISK OF ANY UNAUTHORIZED DISCLOSURE OR INTENTIONAL INTRUSION, OR OF ANY DELAY, FAILURE, INTERRUPTION, OR CORRUPTION OF DATA OR OTHER INFORMATION TRANSMITTED IN CONNECTION WITH THE USE OF THIS SERVICE.  However, once the information you transmit is received by us, your medical information will be treated as confidential and given the same protection by us that all other medical records are given.

It is extremely important that you keep your Patient Portal user ID and password in a secure location and completely confidential. It is your responsibility to prevent disclosure of your temporary access code and password and to change your password and password hint if you feel that your security has been compromised we shall not be liable for any damages that results from your failure to keep your password secure. You can change your password and password hint online at any time.

Patient Portal may contain links to websites operated by other parties. The links are provided for your convenience only.  We have no affiliation with such Web sites or the individuals, organizations or companies responsible for them.   We do not control such websites and we are not responsible for the content and performance of these sites.  The inclusion of links to other websites does not imply any endorsement of the material on the websites or any association with their operator.  In providing such links, we do not represent to you that we have investigated the content of such information, opinions or recommendations, and thus you understand and agree that we do not warrant or guarantee the accuracy of such information or necessarily subscribe to any such opinions or recommendations.  

Use of other sites is strictly at your own risk including, but not limited to, any risks associated with destructive viruses.  You are responsible for viewing and abiding by the terms and conditions of use and the privacy statements of the other websites. Further, to the extent that you make use of any link to any other Web site on the Internet which is made available to you, you hereby agree that you will not reproduce, sell or distribute information or disclose such information to others.

No Warranties

This website and the content contained herein and therein are provided on an "As Is" basis.  We make no representations or warranties of any kind, express or implied, as to the operation of the sites, or the access, content, products and/or services included therein.   WE SPECIFICALLY DISCLAIM, TO THE FULLEST EXTENT PERMITTED BY LAW, ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, COMPLETENESS, TIMELINESS, CORRECTNESS, NONINFRINGEMENT, OR FITNESS FOR ANY PARTICULAR USE, APPLICATION OR PURPOSE.

Limitation of Liability

Some of the material on the site is provided by third parties and we shall not be held responsible for any such third-party material.  We disclaim any responsibility for or liability related to such third-party material. Any questions complaints or claims related to any product should be directed to the appropriate third party.

We may include or provide links to other Web sites on the Internet, including, but not limited to, links to content provider Web pages and online health and medical resources which may include information, opinions or recommendations of various individuals, organizations or companies.

We strive to be a valuable resource of timely information for our users.  We cannot ensure that information we provide is exhaustive or complete on every subject or that it will necessarily include all of the most recent information available on a particular topic.  This information is of a general nature and we urge you to review it with your attending physician.  You should never delay, ignore or fail to obtain medical advice based on information obtained from Patient Portal.

Limited English Proficiency

At this time, the electronic information in online medical records via Patient Portal is not available in non-English formats.

HIPAA and Applicable Law

Your use of the Patient Portal is not intended to substitute for, eliminate or override any patient privacy laws.  In particular, both we and you will continue to be subject to and comply with our respective responsibilities under HIPAA and other applicable law, such as Notice of Privacy Practices and other HIPAA obligations such as amendments to and disclosures of your medical records; and medical care for minors, elderly and incapacitated persons.


You acknowledge that the provisions, disclosures and disclaimers set forth above in these Terms and Conditions are fair and reasonable and that your agreement to follow and be bound to them is voluntary.   You agree that you may not use Patient Portal and shall discontinue use of Patient Portal if any of the Terms and Conditions are not acceptable to you.

By using Patient Portal, you agree that the laws of the state of Washington, without regard to principles of conflict of laws, will govern these Terms and Conditions and any dispute that might arise from the use of this website. You expressly agree that exclusive jurisdiction for any dispute related to the use of this website, resides in the courts of King County, Washington and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of King County, Washington.  Use of this website is unauthorized in any jurisdiction that does not give effect to the terms and conditions set forth herein.
